Booking Terms & Conditions

 

INTRODUCTION

These are the terms and conditions that apply when you book accommodation at Tregoose Old Mill. We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a new booking. The terms and conditions applying to your booking will be those in place on the date that you make your booking.

Additional terms may apply to your booking if you use an authorised third-party digital channel. These are published on the relevant digital channel.

 

MAKING A BOOKING

You must be at least 18 years old to make a booking. Those under 18 years old are not permitted to stay at Tregoose Old Mill. Tregoose Old Mill is an adult only destination. We reserve the right to request formal photo ID from any guests in the form of a driving license or passport.

You will need to provide your credit or debit card details to pay a 50% deposit to secure your booking. We accept Mastercard or Visa for payment. Other payment cards and cash are not accepted.

Please check that the details of your booking are complete and accurate before you confirm your booking. We will not be liable for any delay or non-performance if you provide us with incorrect information.

We will confirm our acceptance of your booking by sending you a confirmation email to the email address that you provide during the booking process. The contract between us for the provision of your accommodation and any additional services added to your booking will be formed when you receive this email confirmation from us.

Bookings are non-transferable between the named booker and other guests or a third party.  

 

SAFETY DEPOSIT

A safety deposit of £100.00 per booking will be taken at the time of booking your accommodation. This will be returned to you within 7 days of departure providing no damages have occurred by you or a member of your party during your stay. Any damages which occur during your stay must be reported to the hosts immediately (between the hours of 07:00 and 19:00, unless it’s an emergency).

ACCOMMODATION RATES

When you make a booking request, we'll give you a total price for the accommodation and number of nights you've requested. The price you pay is the price quoted to you at the time you make your booking.

Any extras not included in the accommodation price may be added to your booking during the booking process or they may be available to you during your stay. You may pay for any selected extras at the same time as your booking.

 

OCCUPANCY

The maximum occupancy is two adults per accommodation. We do not accommodate children below the age of 18. Tregoose Old Mill is an adult only destination. You must not exceed the maximum occupancy of two adults. We reserve the right to conduct checks on occupancy and compliance with these terms. Occupancy is not transferable.

A maximum of two day visitors to the accommodation are only permitted by the express consent of the owners at least 24-hours in advance. Day visitors must leave the premises before 21:00.

 

ACCESIBILITY

Regrettably, Tregoose Old Mill is not suitable for guests with mobility and sight disabilities due the topography of the site and the age of the building with its narrow doorways and steps.  

 

PARKING

Each accommodation at Tregoose Old Mill has one allocated parking space. If more than one parking space is required, please contact us to check options at least 7 days before your stay.

Tregoose Old Mill accepts no liability for the security of guests’ vehicles including their contents. Vehicles are parked at owner’s risk.

 

SPECIAL REQUESTS

Tregoose Old Mill will try to accommodate special requests, subject to availability.

 

PAYMENT

Payment is made at the time of booking by a deposit of 50%. The remaining 50% will be taken 14 days prior to arrival. If full payment is not received within 14 days prior to arrival, we reserve the right to cancel your booking. We accept Visa and Mastercard as payment methods. Cash and other payment cards are not accepted.

 

CANCELLATION

Your right to cancel:

The deposit of 50% taken at the time of booking is non-refundable and non-transferable.

If you cancel your booking between the date the booking is made and up to 14 days prior to arrival the cancellation charge will be 50%, which is the deposit made at the time of booking. 

If you cancel your booking with 14 days of your arrival date the cancellation charge will be 100%.

If you are unable to travel for your booking for any reason, cancellation charges will apply.

If you do not arrive for your booking by 10:00am the day following your expected arrival date, we reserve the right to cancel your booking and the cancellation charge will be made in full, unless you have as advised us in advance that you are arriving later than the expected arrival date.

If you decide to shorten your stay with us whilst you are here, no part refund will be given.

Our right to cancel:

We may cancel your booking at any time with immediate effect by giving you written notice by email if:

You do not pay us when you are required to do so.

You breach the contract between us in any way.

You have previously breached the contract between us in any way.

If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract. Where your stay had/has not yet commenced, the total payment made or to be made by you for such accommodation shall be deemed a cancellation charge.

Events outside our control:

We may also cancel your booking if an event outside of our control (including industrial action, explosion, outbreak of disease, health and safety issues, fire, flooding, and failure of power and/or water supplies or emergency evacuation) means that we are unable to make your accommodation available to you. In this case we will contact you to let you know as soon as possible. In this instance we will provide a full refund or the option to transfer your booking to other available dates.

Save as set out above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control. This does not affect your statutory rights.

 

ARRIVAL & DEPARTURE

Check-in time is from 16:00. If you think you’re likely to arrive after 21:00, please let us know and we will provide self-check in instructions for your accommodation.

Check-out time is before 10:00. Failure to leave your accommodation by this time may result in a late check-out charge of up to one night's additional accommodation charge.

 

HOUSE RULES

You must not:

Be threatening or abusive to any of our team before, during or after your stay.

Smoke anywhere inside any of the accommodations or buildings at Tregoose Old Mill. This includes the smoking of e-cigarettes. Smoking inside our accommodation or buildings will result in a £250 fine.

Cause any health and safety hazard to any of our staff, contractors, or any of our guests.

Bring any pets to Tregoose Old Mill, except for assistance dogs.

Bring any potentially dangerous or hazardous materials or equipment onto our premises.

Tamper with any fire alarms or emergency equipment.

Prevent the owners or staff of Tregoose Old Mill from access to your accommodation.

Remove, damage, or destroy any of our property.

Use any of the technology provided by Tregoose Old Mill to download or access any unlawful or obscene material; or cause unreasonable disturbance to our other guests, staff, or owners.

COVID-19 (also referred to as Coronavirus): you must immediately notify us to the extent you or anyone staying with you is (i) self-isolating or (ii) should be self-isolating pursuant to Government guidelines. In any event, Tregoose Old Mill reserves the right to cancel any bookings (before or during the stay) to the extent it is for self-isolation.

If you or your group cause damage or loss of any kind to the premises, other guests, or their property, you (as the person making the booking) will be responsible for that damage or loss and you shall be liable to pay to Tregoose Old Mill on demand the amount required to make good or remedy such damage or loss.

You and the members of your group must not resell or transfer your booking (or any part of it) nor advertise, market, or otherwise offer any Tregoose Old Mill accommodation for sale either on its own or as part of a combined offer. Tregoose Old Mill will not honour any reservations made in this way and does not accept any liability for doing so.

If you or your group cause damage to the premises, other guests, or their property, or otherwise breach any of these terms and conditions, Tregoose Old Mill reserves the right to:

Cancel your booking with immediate effect and (if appropriate) eject you from the premises.

Remove the keys for our accommodation.

Restrict access to the premises.

Remove your items from the accommodation and premises, disposing of such items (at no cost and no liability) to a local charity to the extent such items are not collected from us within 7 days of removal.

Retain all sums paid by you and/or charge you the full amount of your booking; and/or

Refuse future reservations from you and/or refuse you entry or accommodation.

Tregoose Old Mill will not be liable for any refund or compensation in such circumstances.

We reserve the right to decline or cancel reservations made and stays in progress by those who have previously breached these terms and conditions (as may be updated from time to time), whether the booking is in that name or not.

 

GENERAL

We reserve the right to:

Change your accommodation allocation at any point before or during your stay for any reason.

Cancel any booking(s) due to health and safety concerns or full or partial closure of the premises. In the event we must cancel your booking(s) we will attempt to notify you and a full refund will be processed to the same debit/credit card, though it may take a few days for the funds to reach your account.

 

BOOKING CONTRACT

This contract is formed when we confirm your booking. The contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

 

YOUR RIGHTS

If you are a guest, you have certain rights under consumer protection legislation. Nothing in these terms and conditions is intended to affect those rights.

 

APPLICABLE LAW

These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law.

If you are a guest, you, and we both agree that the court of England will have non-exclusive jurisdiction over any claim arising from, or related to, your booking and/or stay at Tregoose Old Mill. We retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country.

 

SEVERABILITY

If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.

All rights not expressly granted in these terms and conditions are reserved.

 

COVID-19

If you are unable to travel for your booking for any reason, including Covid-19 (Coronavirus), full cancellation charges will apply (50% after booking and 100% within 14 days prior to arrival).
